Welcome to Heathen Sanctuary! The terms “we,” “us,” and “our” refer to Heathen Sanctuary. Heathen Sanctuary operates this store and website, including all related information, content, features, tools, products, and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Heathen Sanctuary is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as preorder purchases, final-sale products, warranty disclaimers, and limitations of liability.

By visiting, interacting with, purchasing from, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy [LINK]. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

Nothing in these Terms is intended to exclude, restrict, or limit any rights or remedies that cannot lawfully be excluded, restricted, or limited under applicable consumer protection law.

SECTION 1 — ACCESS, ACCOUNT & AGE REQUIREMENTS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state, province, territory, or country of residence and are legally capable of entering into a binding agreement.

To use the Services, including accessing or browsing our online store or purchasing any products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information.

You represent and warrant that all information you provide is correct, current, and complete and that you have all rights necessary to provide this information.

You are solely responsible for maintaining the security of your account credentials and for all activity conducted through your account. You may not transfer, sell, assign, or license your account to another person.

Adult and Mature Content

Heathen Sanctuary specializes in books and related products that may contain mature or adult subject matter, including sexually explicit content, graphic violence, disturbing themes, strong language, or other material intended for mature audiences.

By purchasing a product designated for adult audiences, you represent that you meet any age requirements applicable to the purchase of that product in your jurisdiction.

Where provided, content descriptions, warnings, tropes, trigger warnings, or similar information are intended to assist customers but may not identify every potentially sensitive or objectionable element contained within a work.

Customers are responsible for reviewing available product information and determining whether a product is appropriate for them before purchasing.

SECTION 2 — OUR PRODUCTS

We make reasonable efforts to accurately represent our products and services in our online store. However, colors and product appearance may differ from how they appear on your screen due to your device, display settings, lighting, photography, and other factors.

We do not guarantee that the appearance or quality of any product will exactly match photographs, digital renderings, mockups, prototypes, samples, or other representations displayed through the Services.

Special Edition Products

Many products offered by Heathen Sanctuary are specially manufactured, limited-run, collectible, or made specifically for a particular release.

Special edition products may include features such as sprayed or stenciled edges, foil, embossing or debossing, specialty printing, artwork, endpapers, overlays, slipcases, dust jackets, unique bindings, signatures, digital signatures, or other decorative or collectible elements.

Due to the nature of manufacturing, printing, binding, assembly, and fulfillment, reasonable variations may occur between individual copies or between the finished product and any mockup, rendering, prototype, sample, or promotional image.

Such variations may include minor differences in:

  • Color or print appearance

  • Foil placement or coverage

  • Embossing or debossing

  • Sprayed or stenciled edges

  • Artwork or design alignment

  • Binding or spine alignment

  • Dimensions or material appearance

  • Decorative finishes

  • Slipcases, overlays, dust jackets, or other collectible components

Minor manufacturing variations or cosmetic imperfections that do not materially affect the overall appearance, structural integrity, functionality, or readability of a product are not necessarily considered defects or qualifying damage.

All product descriptions are subject to change at any time without notice at our discretion. We reserve the right to discontinue products and may limit quantities offered to any person, household, geographic region, or jurisdiction.

SECTION 3 — ORDERS

When you place an order, you are making an offer to purchase. Heathen Sanctuary reserves the right to accept or decline an order for any lawful reason at our discretion.

Your order is not accepted until Heathen Sanctuary confirms acceptance. We must receive and process your payment before an order is accepted.

Please review your order carefully before submitting it.

Your purchases are subject to our Refund Policy [LINK], including all provisions applicable to final-sale products, special edition books, preorders, damage claims, replacements, returns, and refunds.

You represent and warrant that your purchases are for your own personal or household use and not for unauthorized commercial resale or export.

We may limit or cancel quantities purchased per person, per household, per account, or per order where reasonably necessary, including where we believe an order has been placed for unauthorized resale, fraud, abuse, or circumvention of purchase limits.

SECTION 4 — PREORDERS & FINAL-SALE SPECIAL EDITIONS

Many Heathen Sanctuary products are sold as preorders.

A preorder is an order placed for a product before that product is ready for immediate shipment. Preorder funds may be used in connection with manufacturing, licensing, production, fulfillment, and other costs associated with creating the product.

Unless otherwise stated, payment for a preorder is collected when the order is placed rather than when the product ships.

Final Sale

Preorders and special edition books are final sale once purchased and cannot be cancelled, returned, refunded, or exchanged because of a change of mind, accidental purchase, ordering the wrong item, or no longer wanting the product.

Exceptions may apply when:

  • The product arrives with qualifying damage;

  • The product is defective;

  • You receive an incorrect product;

  • Heathen Sanctuary cancels the product or is unable to fulfill your order; or

  • A return, cancellation, refund, replacement, or other remedy is required by applicable law.

Qualifying damage claims are governed by our Refund Policy.

Preorder Timelines

Any estimated production, fulfillment, or shipping date or window provided for a preorder is an estimate and not a guaranteed delivery date unless expressly stated otherwise.

Special edition production may involve authors, publishers, artists, printers, manufacturers, freight providers, fulfillment partners, customs authorities, and other third parties.

Delays may occur because of printing, binding, manufacturing, licensing, approvals, freight, customs, quality-control issues, supply-chain disruptions, weather, carrier delays, or other circumstances outside our reasonable control.

A delay to an estimated preorder timeline does not automatically entitle a customer to cancel or receive a refund except where required by applicable law.

We will make reasonable efforts to communicate material changes to preorder timelines when appropriate.

Product Changes During Production

Because preorder products may be offered before manufacturing is complete, photographs, mockups, digital renderings, specifications, materials, finishes, dimensions, and other product details may represent the intended design rather than the final manufactured product.

Reasonable modifications may be made during production when necessary to accommodate manufacturing requirements, improve product quality, correct production issues, or address circumstances outside our control.

We will not intentionally make a material change that fundamentally alters the nature of the product without providing appropriate notice or resolution where required.

Cancellation by Heathen Sanctuary

In rare circumstances, Heathen Sanctuary may be unable to produce or fulfill a preorder due to circumstances including cancellation by an author, publisher, licensor, printer, manufacturer, or other production partner; loss of necessary rights or approvals; manufacturing impossibility; insufficient production viability; or other circumstances that make fulfillment impracticable.

If Heathen Sanctuary permanently cancels a product and cannot fulfill your order, we will provide a refund for the affected unfulfilled product unless another resolution is agreed upon with you.

SECTION 5 — SHIPPING, DELIVERY & ADDRESS CHANGES

Shipping and delivery dates are estimates unless expressly guaranteed.

We are not responsible for delays caused by shipping carriers, customs processing, severe weather, governmental action, supply-chain disruptions, or other events outside our reasonable control.

Customer Shipping Information

Customers are responsible for providing complete and accurate shipping information when placing an order.

Because preorder products may not ship for an extended period after purchase, customers are responsible for notifying Heathen Sanctuary of address changes before fulfillment of their order begins.

Address-change requests should be submitted to help@heathensanctuary.com as soon as possible.

We cannot guarantee that an address can be changed after an order has entered fulfillment or been transferred to a shipping carrier.

To the extent permitted by applicable law, Heathen Sanctuary is not responsible for delivery problems caused by incorrect or incomplete shipping information provided by the customer or a customer's failure to notify us of an address change before fulfillment.

Combined Orders and Separate Shipments

Orders containing multiple products may include items with different production or fulfillment timelines.

Depending on the products ordered and our fulfillment practices, items may be held until all products in the order are available or may be shipped separately.

Additional information regarding combined shipping or separate fulfillment may be provided on individual product listings or during checkout.

Nothing in this section limits any rights you may have under applicable consumer protection law relating to lost, undelivered, or damaged goods.

SECTION 6 — PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice.

The price charged for a product or service will be the price in effect when the order is placed and will be shown in your order confirmation.

Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs, duties, or import charges.

Prices displayed in our online store may differ from prices offered through physical events, third-party retailers, or other sales channels.

Promotions may be governed by separate terms and conditions. If promotional terms conflict with these Terms, the specific promotional terms will govern with respect to that promotion.

You agree to provide current, complete, and accurate purchase, payment, and account information for purchases made through our store.

You represent and warrant that:

  1. Payment information you provide is true, correct, and complete;

  2. You are authorized to use the payment method provided;

  3. Charges incurred by you will be honored by your payment provider; and

  4. You will pay all charges incurred at the posted prices, including applicable shipping, handling, taxes, customs, or other charges.

Our Services, including but not limited to trademarks, brands, text, displays, images, graphics, product reviews, videos, audio, and the design, selection, and arrangement thereof, are owned by Heathen Sanctuary, its affiliates, licensors, or applicable rights holders and are protected by applicable U.S. and international intellectual property laws.

These Terms permit you to use the Services for personal, non-commercial purposes only.

You must not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit material from the Services without authorization from the applicable rights holder, except as otherwise permitted by law.

Nothing in these Terms grants you a license or other right under any patent, trademark, copyright, or other intellectual property belonging to Heathen Sanctuary, Shopify, our licensors, authors, artists, publishers, or other third parties.

Heathen Sanctuary's names, logos, product names, service names, designs, and slogans are trademarks of Heathen Sanctuary or applicable licensors. Shopify's names, logos, product and service names, designs, and slogans are trademarks of Shopify.

All other names, artwork, book content, characters, logos, trademarks, and intellectual property remain the property of their respective rights holders.

SECTION 8 — OPTIONAL TOOLS

You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor control.

You acknowledge and agree that we provide access to such tools “as is” and “as available” without warranties, representations, or conditions of any kind and without endorsement.

We shall have no liability arising from or relating to your use of optional third-party tools to the extent permitted by law.

Your use of optional tools is at your own risk and discretion, and you should review and approve the terms under which the relevant third-party provider offers those tools.

SECTION 10 — RELATIONSHIP WITH SHOPIFY

Heathen Sanctuary is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Heathen Sanctuary.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Heathen Sanctuary, including any injury, damage, or loss resulting from purchased products and services.

You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Heathen Sanctuary.

Occasionally, information on or within the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, specifications, pricing, promotions, offers, shipping charges, transit times, preorder estimates, or availability.

We reserve the right to correct errors, inaccuracies, or omissions and to change or update information where appropriate.

If an error materially affects an order already placed, we may contact you regarding the error and, where appropriate, cancel and refund the affected product or provide another resolution consistent with applicable law.

SECTION 14 — PROHIBITED USES

You may access and use the Services for lawful purposes only.

You may not use the Services, directly or indirectly:

  • For unlawful or malicious purposes;

  • To violate applicable laws or regulations;

  • To infringe our intellectual property rights or those of another person;

You will remain liable for amounts properly due up to and including the date of termination.

Provisions that by their nature should survive termination will continue to apply, including provisions relating to Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Governing Law, and other provisions intended to survive.

WE DO NOT GUARANTEE THAT USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

SOME JURISDICTIONS LIMIT OR PROHIBIT CERTAIN WARRANTY DISCLAIMERS, IN WHICH CASE SOME OR ALL OF THE ABOVE MAY NOT APPLY TO YOU.

SECTION 18 — LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, HEATHEN SANCTUARY, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS PROCURED THROUGH THE SERVICES.

THIS MAY INCLUDE, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

You agree, to the extent permitted by applicable law, to indemnify, defend, and hold harmless Heathen Sanctuary, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from third-party losses, damages, liabilities, or claims, including reasonable attorneys' fees, arising from:

  2. Your violation of applicable law or the rights of a third party; or
